This Policy aims to inform you about the processing of your personal data carried out by Metahood Inc..

1. WHO ARE WE?
Metahood Inc., a company incorporated and headquartered at 1209 Orange Street, City of Wilmington, State of Delaware, United States, is providing You with our Services.
We are the controller of your personal data (i.e., the entity that determines the purposes and means of processing your personal data) carried out on Turnme.ai.
Your responsibility
Our role at Turnme.ai is mainly to provide You with an astonishing technical infrastructure that allows You to turn your ideas into reality thanks to AI tools. We process your personal data to ensure a smooth process in this creative work.
Once you create Media and Models of You or third parties (with their authorization - read our Community Standards for more information), you are free to use, share, adapt them. If such Models or Media contain personal data, you could be deemed as controller for the subsequent processing because We do not control or determine further uses of them.
2. HOW AND WHY IS MY PERSONAL DATA PROCESSED BY TURNME.AI?
Turnme.ai collects and processes your personal data in a way that is relevant, adequate, non-excessive, and strictly necessary for the purposes for which it is to be used.
Below is all the information relevant to the processing of your personal data, including (i) our goals in processing your data, (ii) the types of personal data we collect, (iii) the legal basis for processing, and (iv) how long we retain your personal data.
2. HOW AND WHY IS MY PERSONAL DATA PROCESSED BY TURNME.AI?
1. Enable Access to Turnme.ai
Purpose: Allow you to access Turnme.ai and use its functionalities by depositing strictly necessary cookies.
Data Collected: Information about the device used to access and use the site, including IP address, technical characteristics and operating data, operator, operating system, device model, language preferences, and access date and time.
Legal Basis: Our legitimate interest in providing a functioning website.
Retention Period: Cookies have a lifespan of 13 months, and the information collected is retained for 25 months.
2. Audience Analysis
Purpose: Conduct anonymous statistical analyses of Turnme.ai’s audience to improve and optimize functionalities, content, and browsing experience.
Data Collected: Audience data collected through cookies.
Legal Basis: Your consent.
Retention Period: Cookies have a lifespan of 13 months, and the information collected is retained for 25 months.
3. Account Creation and Management
Purpose: Facilitate the creation and management of your Turnme.ai account.
Data Collected: Email address, password, username, and biography.
Legal Basis: The performance of our Terms.
Retention Period: Account information is retained for 2 years from your last connection.
4. Payment Processing and Fraud Prevention
Purpose: Allow you to pay for Credits and ensure payment security, including fraud prevention.
Data Collected: Information related to the chosen payment method, such as credit card number or account details for services like PayPal.
Legal Basis: The performance of our Terms.
Retention Period: Payment service providers retain this data for 13 months from the payment date.
5. Customer Support
Purpose: Assist you with your Turnme.ai experience by addressing questions and complaints (contact: support@turnme.ai).
Data Collected: Email address and personal information arising from your inquiry or complaint.
Legal Basis: Our legitimate interest in ensuring a smooth user experience.
Retention Period: Questions and complaints are retained for 5 years after resolution for evidentiary purposes.
6. Marketing Communication
Purpose: Communicate with you about the latest events and offers.
Data Collected: Email address and relevant commercial information, such as credit history, that allows for personalized offers.
Legal Basis: Our legitimate interest in promoting our services.
Retention Period: If you haven’t purchased Credits, we will not contact you. Your information is retained for 3 years from the last interaction (typically, when you delete your account).
7. AI Generating Services
Purpose: Provide AI generating services, create new Media and Models, and highlight popular prompts.
Data Collected: Media that you search, upload, or generate on Turnme.ai, including your prompts.
Legal Basis: The performance of our Terms.
Retention Period: Retained until you delete your account.
8. AI Model Training
Purpose: Train AI Models on your User Generated Content.
Data Collected: User Generated Content.
Legal Basis: Our legitimate interest in improving AI tools for enhanced future services.
Objection: You can object to this processing at any time by contacting privacy@turnme.ai.
Retention Period: We do not use User Generated Content after account deletion.
9. Content Moderation
Purpose: Moderate content on Turnme.ai (see Community Standards for more information).
Data Collected: Reported User Generated Content, report descriptions, and sanctions decisions.
Legal Basis: Legal obligations to promptly remove illegal or illicit content.
Retention Period: Retained for 5 years post-decision for evidentiary purposes.
10. Litigation and Pre-Litigation Management
Purpose: Manage disputes or pre-litigation cases.
Data Collected: The type of data processed depends on the specific dispute, potentially including any data mentioned here.
Legal Basis: Our legitimate interest in protecting and defending our rights.
Retention Period: Retained until all appeal delays have expired.
11. Individual Rights Requests
Purpose: Manage requests to exercise individual rights.
Data Collected: First name, last name, contact details, and any other relevant personal data targeted by the request.
Legal Basis: Compliance with our legal obligations.
Retention Period: Proof of identity (if required) is deleted once the request has been processed, although it may be retained for up to 6 years if litigation risk is high. Data related to the request is kept until the request is resolved, with responses retained for 6 years from closure.
12. Financial Transactions
Purpose: Manage mergers, acquisitions, or other financial transactions involving Metahood Inc..
Data Collected: The type of data processed depends on the transaction, potentially including all data listed here.
Legal Basis: Our legitimate interest in conducting financial transactions.
Retention Period: Data is processed from due diligence through to transaction completion.
4. DO YOU DISCLOSE MY PERSONAL DATA TO THIRD PARTIES?
We undertake to share your personal data only in certain circumstances and in accordance with applicable laws. We only share your personal data with duly authorized recipients, as described below. All recipients who process your personal data are subject to confidentiality obligations.

- AI Base Model providers, to help generate Media and Models
- Payment services providers, to help you acquire Credits
- Communications services providers, to keep in touch with you
We may also share your personal data with third parties in the event of a merger or acquisition of all or part of Turnme.ai by a third party, or in the event of a sale, transfer, or restructuring.
5. IS MY PERSONAL DATA TRANSFERRED OUTSIDE OF THE EUROPEAN UNION?
Your personal data may be transferred to countries outside the European Economic Area that do not have an adequacy decision from the European Commission (list available here) and more specifically the following countries:

Where your personal data is transferred to one of these countries, We undertake to ensure an adequate level of protection through the following appropriate safeguards and measures:
- Data Privacy Framework or, when it is not applicable, Standard contractual clauses.

6. HOW CAN I EXERCISE MY RIGHTS?
You have the following rights with respect to your personal data:
- If your personal data has been processed with your consent, you are entitled to withdraw your consent at any time without this affecting the processing carried out prior to the withdrawal.
- You have the right to access the personal data we hold about you (provided that the request is not manifestly unfounded or excessive, in particular because of its repetitive nature), and to obtain a copy.
- You may request that your personal data be corrected if it is inaccurate or out of date, and/or that it be completed (provided that the request is not manifestly unfounded or excessive, in particular due to its repetitive nature).
- You may request that your personal data be deleted. However, this is not an absolute right, as we may be obliged to retain your personal data for legal or legitimate reasons.
- You may exercise your right to deletion in the following cases: if you have validly objected to the processing of your personal data or have withdrawn your consent, if the personal data is not or is no longer necessary for the purposes for which it was originally collected, or if the personal data is unlawfully processed by us.
- You may request the restriction of processing. This right means that the processing of your personal data by us is limited, so that we can keep this data, but we cannot use or process it.
- This right applies in special circumstances, namely (i) if you dispute the accuracy of your personal data: the processing is then restricted for a period of time allowing us to verify the accuracy of the data; (ii) in cases where the processing is unlawful and you object to the erasure of your personal data and instead require the restriction of their use; (iii) in cases where we no longer need the personal data for the purposes mentioned above in section 2, but they are still necessary for us to establish, exercise, or defend legal claims; and (iv) in cases where you have objected to processing based on our legitimate interests, you may request that processing be restricted for the period necessary to determine whether we can comply with your objection request.

- You also have the right to give us instructions on what to do with your personal data in the event of your death.

Where we process your personal data on the basis of our legitimate interests (see the table in section 2 of this Policy for data processing based on our legitimate interests), you may at any time object to the processing of your personal data on grounds relating to your particular situation, unless we demonstrate compelling legitimate grounds for the continued processing of such data or where such data is necessary for the establishment, exercise, or defence of legal claims.

You have the right to lodge a complaint with the competent national supervisory authority.
